West Bengal State Assembly Passes Resolution for the creation of Legislative Council

The West Bengal Legislative Assembly passed a resolution yesterday to create a Legislative Council in the state under Article 169 of the Constitution of India that deals with the Abolition or creation of Legislative Councils in States.

The resolution was moved by state Parliamentary Affairs Minister Partha Chatterjee after 196 MLAs voted in favour of the resolution and 69 voted against it.

The resolution now awaits confirmation from the Governor after which the Legislative Council would be set up in West Bengal.

West Bengal had an Upper House that was formed in 1952. However, it was abolished in 1969 by the resolution passed by the West Bengal state assembly.

The same has happened in Jammu and Kashmir where by J&K Reorganisation Act, 2019, the Kashmir Legislative Council was abolished. The Andhra Pradesh Legislative Assembly had also passed the resolution for the abolition of the Legislative Council last year which has not yet been passed by the Parliament as of now.

Presently, Andhra Pradesh, Telangana, Uttar Pradesh, Bihar, Maharashtra, Karnataka are the only 6 states having a legislative council.
