Kerala High Court dismisses plea to establish Supreme Court benches in all High Courts and increase retirement age of judges to 75 years

Recently a plea has been dismissed by Kerala High Court by a bench of division bench of Chief Justice S Manikumar and Justice Shaji P Chaly where Abdul Jaleel, asked for raising the retirement ages of all judges in the country to 75 years.

The solicitor had looked for the accompanying requests from the Court:

To lay out a two-judge seat of the Supreme Court in every one of the High Courts of the country to hear just the instances of poor people and the penniless. To satisfy this plea, direct the Supreme Court registrar General to do whatever it may take to put this Petition under the watchful eye of the Hon’ble Supreme Court Chief Justice;

Direct the Central government to do whatever it may take to improve the retirement age of the appointed authorities of the Supreme Court, High Courts and every one of the legal officials of the country to 75 years; and assuming fundamental by correcting the constitution which results into savings of public cash which can be utilized for different purposes.

Direct the Central government to do whatever it may take to guarantee that legal officials in the nation will not acknowledge any post in that frame of mind after retirement.

The judges saw that while the applicant had raised serious charges of debasement against the judiciary, the Court can’t pass any request considering the idea of the reliefs looked for.

Though the petitioner – party-in-person has alleged that some of the judges were hand in glove with the criminals and obtained post retirement postings, which allegations are very serious, having regard to the reliefs sought for, we are not inclined to advert to the same and no direction in the nature of mandamus as prayed for, can be granted,” the judgment stated.
