No infirmity, illegality or perversity or impropriety” – Special court of Delhi passed order against CM Arvind Kejriwal, Deputy CM Manish Sisodia and ors in case of assault
An FIR registered by Prakash for assaulting and intentionally causing hurt, compelling to follow unlawful directions discharging his official duties in CM’s residence. All others present found to possess intention of criminal conspiracy.
The court observed CM Arvind Kejriwal, Deputy CM Manish Sisodia and nine ors. convicted for the offences under Section 109, 114, 120, 342, 506 of IPC.
Advocate Hariharan argued that there was no meeting of minds of the accused such as his actions was not illegal and thus, the allegations against the petitioner was sudden. No infirmity in impugned order he added.
The court said that the order is not illegal. Merely conducting the meeting at midnight 12′ o clock does not constitute pre planned and unlawful assembly. The assembly conducted was in common intention and not intent criminal intimidation.
Considering there was no meeting of minds prior the assembly, no conspiracy, no prior mediation the court upheld the order and dismissed the revision petition filed challenging the order discharging the accused.
