Supreme Court denied Gyaspur Colony Resident’s plea, advised them to come through established legal path

Supreme Court Bench, presided by J. KM Joseph and BV Nagarathna, on Monday refused to entertain pleas moved by residents of Gyaspur colony, South Delhi, challenging the order of Delhi High Court regarding their rehabilitation under the Delhi Slum and JJ Rehabilitation and Relocation Policy, 2015. The petition was filed by jhuggi dwellers from Sarojini Nagar against the demolition order without rehabilitation of the slum dwellers. In April 2022, Court had also resisted the centre from taking any coercive steps for eviction. The Bench noted that the main petition was still pending before the High Court and expressed its unwillingness to hear the IA at the beginning of the hearing itself. While rejecting the plea, the court asked the petitioner to go through the proper route.

The Court said, “Come through the route, you may claim easily like this just because you are in Delhi, right? How about those who live in other regions of India? Can they arrive in this way? Delhi residents’ convenience cannot be taken into account, and as per the record, your writ petition is also not disposed off till now. All must follow the route, which includes the Supreme Court, High Court, and subordinate courts. You, too, came through the same path.”
