Karnataka HC demands an actual figure of expenditure expenses by the wife for the claiming – on the plea seeking 6 lakhs as monthly interim maintenance

The single-judge bench of Justice Lalitha Kanneganti was surprised after an estranged wife filed an application seeking 6,16,300 per month as an interim maintenance amount from her husband said does anybody spend this much who is a single lady for herself without having any responsibility for the family and children. The 6 lakhs she wants to spend let her earn not on the husband because that’s not the purpose of sec 24 of the Hindu Marriage Act.

Further, it said having a dispute with the wife was not a punishment to grant 6 lakh as interim maintenance. The wife should be reasonable in telling it and let the court decide to give some amount or other

The court expressed concern over the high expenses claimed by the wife Rs 50000 per month, Rs 15000 for clothing and accessories, Rs 60000 for monthly expenses, and 4-5 medical costs which the judge found excessive for a person with no dependents and instruction.

Also, if a husband has 10Cr of income, the court can’t grant Rs 5Cr to the wife of his income for her excessive expenditure requirement.

The wife requested the court increase her maintenance from Rs 50,000 to 5 Lakhs per month and the husband’s counsel argued that she had 63 Lakh in her account. Following this, the court said the husband would file all documents through an affidavit and

The wife shall also file an affidavit to disclose her expenses on the next hearing on 9 September.
