HC order allowing D.U to use CLAT scores | SC refuses to interfere

Issue: – A Special Leave Petition was filed by a student, who had demanded for the admissions to take place through the CUET and not CLAT.

Analysis: – The bench which was led by Chief Justice of India DY Chandrachud, dismissed the SLP

The bench said that it is an interlocutory order. The same can be argued in the HC but for this year the CLAT will continue.

On 18th September, the interim order was passed by the division bench comprising Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula of the Delhi HC, whereby permitting Delhi University, to offer admission to its new integrated 5-year LLB course based on the score of CLAT 2023.

It was observed by the bench that this is a matter that requires consideration on the point of whether CUET should be mandatory for admissions in all the Central universities or whether these universities will have the liberty to take admissions through other exams.

The court said that even if it is a point of consideration, the classes for the academic year of 2023-2024 have already begun based on interim relief.

Judgment: – The Supreme Court refused to interfere with the order of the Delhi HC whereby it allowed the university to admit students in the 5-year integrated LLB course based on CLAT.
