Jammu & Kashmir High Court notifies rules for Live Streaming and Recording of Court Proceedings

The Jammu and Kashmir and Ladakh High Court notified rules for live streaming and recording court proceedings published by Shahzad Azeem, registrar general of the high court, on Monday. 

In its notification, it said, “these rules shall be called, ‘live streaming and recording of court proceedings rules of the high court of Jammu & Kashmir and Ladakh, 2023. These rules will apply to the high court of Jammu & Kashmir and Ladakh and to the courts and tribunals over which it has supervisory jurisdiction”

It said that all the proceedings will be live-streamed, which will be subject to the exclusions contained in these rules.

As per rule number 5, matrimonial matters, cases concerning sexual offences, POCSO offences, and matters involving, the medical termination of pregnancy act, 1971 are prohibited from live streaming. Also, the recording of evidence, including cross-examination, in camera proceedings as defined under section 327 of CrPC and section 153 B of CPC, privileged communication between parties and their advocates are also excluded from live streaming.

Further, the notification stated that any matters, in the view of the bench, that can provoke enmity amongst communities and are likely to breach law and order are also exempted from live streaming. Any other matter in which a specific direction is issued by the bench or the Chief Justice will also be excluded from live streaming.

Rule 9 states the restrictions and prohibitions on the usage of recordings and live streams.  It says that no person/entity other than an authorised person/entity shall record, share or disseminate live streams or archival data. The use of the recordings shall be permitted through the written authorization of the court. 

The bench added, the decision of the bench will be guided by the principle of an open and transparent judicial process.
