Delhi HC to Meta: “Situation worse than a government department”

The Delhi HC called for the response of the tech giant Meta as it had failed to give a proper reply to the plea that was filed by TV today, as the Instagram page of Harper’s Bazaar India, which is owned by TV Today was blocked by Meta.

The division bench of Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora remarked that the functioning of Meta appeared to be worse than the government department.

The bench gave the warning that Meta should put its house in order or a castigating order could be passed against the platform.

TV Today has also challenged the constitutionality of rule 3 (1)(c) of the IT Rules.

It said that as per this rule, the intermediaries are allowed to block access to the accounts without providing a fair opportunity to the users to contest their position. As a result, certain ambiguities in the IT Act are being misused.

Advocate Hrishekesh Baruah who appeared for TV today, argued that it was written by them, thrice, to Meta and they even reached out to the grievance redressal officer. They were given the response that they had not written to the right channel.

Advocate Tejas Karia who appeared on behalf of Meta said that the content was blocked after three copyright strikes.
