40-Year-Old Trademark Dispute Decided By Delhi HC

One of the oldest intellectual property disputes which was pending before the Delhi HC has been disposed of by it.

Justice Pratibha M. Singh had passed the order in the case after nearly 40 years PM Diesels Private Limited had filed the suit against a firm that was named Thukral Mechanical Works for restraining the latter from using the trademark “FIELDMARSHAL”

His relief was granted to PM Diesels, whereby it noted that the battle between the two was a long one and substantial costs have been incurred by PM Diesels to protect the trademark, “FIELDMARSHAL”,

Over four decades, the case traversed through various courts including the Delhi High Court and the Karkardooma district court, as well as the Intellectual Property Appellate Board (IPAB).

On April 2, 2024, Justice Singh ruled in favor of PM Diesels, prohibiting Thukral Mechanical Works from manufacturing products under the ‘FIELDMARSHAL’ mark.

However, Thukral Mechanical Works was granted six months to sell its existing stock bearing the mark, with a directive against any fresh manufacturing under the same mark.

This case underscores the significance of trademark protection and the legal processes involved in resolving intellectual property disputes.
