Delhi High Court Directs Removal of Allegedly Defamatory Video on Sadhguru and Isha Foundation by YouTuber Shyam Meera Singh

Delhi’s High Court directed the recent YouTuber Shyam Meera Singhube YouTube video on Wednesday on the Isha Foundation and its founding spiritual leader Sadhguru Jaggi Vasudev.

The video entitled “Sadhguru presented: What is happening in the Ashram of Jaggi Vasudev” was uploaded by Singh on his YouTube channel on February 24 and shared it on his page ‘X’ with accusations that suggested that the minors were being exploited in the Ashram. At present, the video has 937k views, 65k I like and 13k comments.

Justice Subramonium Prasad addressed the defendants Google LLC, X Corp and Meta Platforms to eliminate the video in question. The bank also prevented Singh from publishing or sharing the video in question in question.

“The defendant No.4, his associates, servants, agents, affiliates, assignees, substitutes, representatives, employees and/or persons who claim it through it create, publish, upload, share, share, spread, etc. The defamatory videos as they are listed in paragraph 8 of the demand and all videos/publications/publications/allegations that emanate outside Paragraph 11 of the demand and all videos/publications/publications/allegations that emanate the output of the falfamatorable videos as listed in the paragraph. Judge Prasad also prevented the public members from carrying said video on any social media platform.

The Court approved the intermediate order in a defamation lawsuit filed by the ISHA Foundation against Shyam Mera Singh. Meanwhile, the ISHA Foundation requested to knock down or eliminate the video, claiming that the same is defamatory.

In his order, the court said that Shyam Meera Singh made the YouTube video based on “unseeding material” and that the video title is a clickbait to attract public attention.
“In the opinion of this court, the content mentioned in the video is per defamatory and they directly prevent the plaintiff’s reputation in the eyes of the general public, since it establishes that the plaintiff follows certain practices that are not accepted in the company,” he said.

Judge Prasad said that before uploading the video, Singh also made tweets and publications on social networks to promote this video.
“It is well established that reputation is an integral part of the dignity of each individual and there is a need to balance between freedom of expression and freedom of expression against the right to reputation that has been considered as part of the right to life under article 21 of the Constitution of India. The video has a direct impact on the reputation of the founder of the plaintiff/trust, ”he said.

The defamation demand of the ISHA Foundation is presented through the lawyer Yajat Gulia. The ISHA Foundation was represented by Senior Mansh Dogram lawyer along with a team of Athena Legal lawyers comprising Simranjet Singh, Gautam Talukdar Rishabh Pant and Yajat Gulia.

The demand will now be heard on July 9. The provisional relief application is listed for the hearing below on May 9.
