“Supreme Court Seeks Report From Collector On Recovery Of Rs 1 Lakh Cost Imposed On Lawyer For Frivolous Petition”

The Supreme Court in India ordered a collector’s report on the non -Calculation of RS. 1 Lakh fine imposed on lawyer Lucknow Ashok Pandey. This fine was the result of the frivolous petition he filed and questioned the restoration of Lok Sabha Mohammed Faizal. On October 20, 2023, Pandey claimed that a member of Parliament (MP) remains disqualified after he lost his office due to a criminal conviction until he was exempt from a higher court.

Bench of Judge B.R. Gavai, Aravind Kumar and Prashant Kumar Misra, rejected the petition and described it as an “abuse of the process of the legal process”. The court noted that the fundamental rights of Pandey were not violated and therefore could not cause extraordinary jurisdiction under Article 32 of the Indian Constitution.

The court ordered the cost of Rs. 1 lakh, be placed in the defense law fund. From this amount, Rs. 50,000 was assigned to the Supreme Court Association for the purposes of the library and the remaining RS. 50,000 was intended for the Social Security Fund of the Supreme Court for the Recording Association.

Given that the fine was not paid, the court ordered to be renewable as soil income arrears. In the subsequent hearing on the failure to comply with this order, the Court stated: “We call on a report from the collector why the order approved by the court and the costs were not obtained.” The message is expected within four weeks. Attorney Pandey faced previous fines, including separate RS. 5 Lakh’s costs for another frivolous petition concerning the validity of the oath accepted by the chief judge of the High Court in Mumbai.
