SC directs pay hike for Judicial Officers as per Judicial Pay commission Recommendations from Jan 1, 2016; Arrears to be paid by June 30, 2023

SC ordered to implement pay structure as per Second National Judicial Pay Commission.

The bench directed State and Centre to pay arrears within June 30, 2023 with 3 installments;

  1. 25% in 3 months
  2. 25% next 3 months
  3. Balance by June 30, 2023

The court found Judicial Officers are excluded by pay commission. The Centre and State while making pay scale for government servants once in 5-10 yrs did not include Judicial Officers, which the court found it necessary and revised the pay structure.

After reviewing service condition of the district judiciary the court concluded the two pending issues;

  1. Pay scales of subordinate judiciary
  2. Pension/retiral benefit

The judges then revised the pay scale of the Second National Judicial Pay Commission which was constituted by SC in 2017.The court found the State refused to pay the revised pay to all Judicial Officers and Retired because they were not having sufficient funds which is ‘unjust’.

The Apex Court further granted interim relief and directed to pay 30% more than their basic pay including accrued increments for all the Judicial Officers disregarding categories/ranks.

The Chief Justice of India NV Ramana inclined to implement the revised pay scale of 2016 and remarked since it’s already been a delay from 6.5 years.

The top court considered the above facts directed to pay the cash in 3 installments starting off immediately.

The bench included Chief Justice of India NV Ramana, Justices Krishna Murari and Hima Kohli.

The judges association included the petitioners such as; Senior Advocate Banerji, Purvat Wali Advocates, Ms. Mayuri Raghuvanshi, Advocate-on-record Vyom Raghuvanshi.
