Plea in Delhi HC for livestreaming of Same – Sex Marriage Case

The central government has recently opposed a demand for the livestreaming of proceedings before the Delhi High Court for the case seeking legal recognition of same sex marriages.

The government has contended that the matter is neither of national importance and nor does iy affect the majority population of the country.

The government further contended that the purpose of seeking live streaming is mala fide and to attract unwanted media attention.

An application had been filed by one of the petitioners in 2021 asking the court to livestream the proceedings. This was filed in light of the Supreme Court’s direction in Swapnil Tripathi vs Supreme Court of India.

The SC in it’s order had said that there should be Live Streaming of court cases in matters of constitutional and national importance which effect the public at large.

The central government has opposed the application. In it’s affidavit it said that neither is there any violation of a fundamental right nor is the case of national importance.

It was further added that this was an attempt by the applicant to create dramatic effect and generate sympathy for the application.
