In a case recently heard in Patna High Court (Kunal Kaushal v. The State of Bihar and Ors),27 law institutions of the state were found to have inadequate infrastructure and facilities due to which the High Court decided to put a stay on them taking new admissions.
The petition was filed by one Kunal Kaushal who prayed before the court that posts of permanent teaching faculties in the law college under the Tilka Manjhi Bhagalpur University (TMBU) be filled up.
The petitioner brought it to the notice of the court that no Principal, since the year 1992, stood appointed at T.N.B. Law College, Bhagalpur.
The plea was heard before the Bench of Chief Justice Sanjay Karol and Justice S Kumar who decided to take notice of the plea, but excluded Central University, Gaya, and Chanakya National Law University, Patna from the list of inadequate infrastructure law schools.
the Court ordered, “We direct that without leave of the Court, no educational institution, be it a university/law college, shall admit students in the next academic session”.
The court further ordered the state government and the Bar Council to file affidavits enclosing the status report of the existing infrastructure and lack thereof.
Through the reports, the court concluded the Court noted that “save and except for the (i) Central University, South Bihar, Gaya, Bihar, and (ii) Chanakya National Law University, Mithapur, Patna ,all other institutions/law colleges were deficient in meeting the infrastructural requirements, mandatory in nature.
Hence, till further notice these 27 educational institutions cannot take up new admissions.
