Caste System Is A Deep Rooted menace: Allahabad High Court.

In the case of Sanni Singh v. state of Uttar Pradesh, a single bench of Justice Rahul Chaturvedi recorded his deep concerns regarding the menace of the deep-rooted caste system in the society. A criminal appeal under section 14 A (2) of SC/ST. The act was filed for setting aside the order of dismissal of Bail Application by the learned Special judge, SC/ST Act Add. Session Judge in Crime No. 291 of 2021, u/s 302, 307, 506, 120B IPC and sec. 3(2)(V) of SC/ST Act.

The Prosecution story was that one Anis Kumar who belongs to the SC community was posted as gram panchayat Adhikari at Urwa Block, Gorakhpur. During his training period, he developed intimacy with her course-mate Ms. Dipti Mishra an upper-class girl. Despite all odds and objections from the family members, they got their marriage registered and started living together as husband-wife. Infuriated by this, a conspiracy was hatched to eliminate Anis. On 24.07.2021 Anis Kumar was attacked by two motorcyclists with sharp-edged weapons. As a result, Anis Kumar was declared dead by the doctor. The prosecution relied upon the case of Rama Devi Nayar vs. the state of Rajasthan 2020(4) SCC Crl.185 (Honour killing). But in the present criminal appeal, the applicant is nowhere concerned with the family of Ms. Dipti Mishra and thus shared no emotional bonding with the lady.

The court recorded that it is mind-boggling that the widow of the deceased is not safe.  Even after 75 years of Independence, we are not able to get out with this social menace. This is pitiable and tragic.

Meanwhile, the court granted Bail to the applicant keeping in view the nature of offence, evidence, manner and mode, the period of detention.
