Bombay High Court grants bail to UAPA suspect despite oath acknowledging ISIS Chief as Muslim Caliph

Mohammad Raisuddin, who was detained in 2016 under the Unlawful Activities (Prevention) Act (UAPA) on suspicion of having ties to the Islamic State, was granted bail by the Bombay High Court on Monday (ISIS).In the case, Mohammad Raisuddin v. NIA & Ors, Justices Revati Mohite Dere and VG Bisht grants bail to UAPA accused saying that mere suggesting that everyone should work for Islam could not be said to be an offence. Prosecution was based on the conversation which took place between the accused and four others over threats to Islam, actions of the ISIS and other issues like beef ban, communal riots, injustice to Muslims in Palestine, etc. the prosecution alleged that the appellant was inspiring the group of people to work for Islam in reference to the above-mentioned issues. The council of appellant denied of their client taking any such oath and argued that because he had been detained since 2016 and because none of the 550 witnesses in the case had been questioned, the trial would probably drag out and he pleaded for the granting of release.The Court came to the conclusion that the trial would take some time to start because there were so many witnesses to question. Because of the evidence, seriousness of the allegations, and length of time the appellant had already spent in jail, the Court decided to give him release with some restrictions.
